In the Name of Allah, the Most Gracious, the Most Merciful

Praise be to Allah. We thank Him, ask for His forgiveness, and seek protection in Him from our wicked deeds and sins. Those whom Allah guides are truly well-guided, and those whom He does not guide will never be guided. I testify that there is no God but Allah, and that Muhammad (pbuh) is His servant and messenger.

Complying to Allah's saying: "and warn, for warning profits believers" [Al Dhareyat: 55], it is a pleasure for those who work in the Zakat Fund to present to the brothers and sisters a synopsis on the Fiqh of Zakat, adhering to Allah's Order on warning, and realizing the responsibility that lies on the fund to serve this duty – the duty of Zakat – and performing what it entails, including the dissemination of awareness of  Zakat as a duty, receiving its allocations and dispending these allocations to their deservers, as well as other ways and factors that help fulfill that duty in the best way.

This synopsis comprises exemplary questions and queries that have been replied to through the "they ask you about Zakat", a service initiated by the Zakat Fund; and to get the full benefit of this synopsis, we present it with an introduction that highlights the status of Zakat in Islam, its status in Islamic law, its benefits and the conditions of its liability. In preparing this synopsis, we avoided unnecessary redundancy and excessive brevity by stating only the opinions authenticated by religious scholars, except in few places where it was necessary to mention other opinions.

Also, to get the full benefit of this synopsis and in order for it to appear in the best form, we had submitted it to a number of high caliber scholars – may Allah reward them all well – to revise and ratify. We think that we – those responsible for the Zakat Fund – dedicate this sincerely to Allah, fulfilling our duty, as the official body responsible for Zakat issues in the United Arab Emirates – may Allah keep it secure and stable – and we believe it a must that we propagate the Fiqh of Zakat among people, especially that we notice a dire need for that through communicating with the public via the "they ask you about Zakat" Service. What is right in this work is Allah's work only, and the wrong is what is done by ourselves and the Satan. We seek refuge in Allah from Satan and ask Him for His forgiveness.

We ask Allah to make this work sincerely dedicated to Him, and to make Muslims benefit thereof, and may peace be upon Prophet Muhammad (pbuh) and all his family and companions.

1- Question: I have a hundred sheep; I want to know its Zakat and is it allowed to offer its Zakat in money according to sheep price in the market?

Answer: Zakat amount of A hundred sheep is one sheep that completed its first year for sheep and its second year for goats if they were grazing livestock. However, if they are fodder-fed i.e. you feed them from your own; there is no Zakat upon them according to all scholars as the Prophet (PBUH) said," As regards the Zakat for the (flock) of sheep" as charity is cancelled by grazing livestock in contrast with Al Mlikiyah who imposed Zakat on grazing livestock as well as others. The first opinion is more probable according to the previous hadith.

It is more preferable to offer Zakat upon cattle from these cattle and not paying their value in money because the majority of scholars did not allow paying Zakat in money in stead of substance Zakat in contrast with Al Hanafiyah who allowed this case. Indeed, it is permissible to pay Zakat in money for its value for the poor. However, it is more adequate to pay Zakat upon sheep from these sheep and Allah knows best.

2- Question: I have nine camels and their offspring; how could I calculate their Zakat?

Answer: If you were feeding them from your own money, there is no Zakat for them. If they were grazing livestock; grazing and feeding themselves without your effort, then they have Zakat according to the majority of scholars as the Prophet (PBUH) said, "There is grazing livestock in cattle". Al Malikiyah said that there is Zakat upon stall-fed cattle and that graze freely. Zakat of nine camels is one camel as well as their offspring that is calculated in Zakat. Therefore, you should consider the number of cattle and their offspring again. If their offspring are four, then the total number is thirteen and their Zakat becomes two shahs. If their offspring are six, then the total number is fifteen and their Zakat becomes three shahs. And Allah knows best.

3- Question: We have 120 of sheep; what is the amount of Zakat?

Answer: If the sheep are grazing livestock without any effort of their owner, then their Zakat is one sheep not less than a year old and not less than two years old from goats. However, if the owner is feeding them from his own money all the year, they have no Zakat according to the hadiths that stipulated paying Zakat for grazing livestock as the Prophet (PBUH) said," As regards the Zakat for the (flock) of sheep". However, Al Malikiyah imposed Zakat on grazing livestock as well as others. And Allah knows best.

4- Question: We have 120 of sheep that are in possession for a year; what is the amount of Zakat? We also have four cows. Tell us, may Allah reward you for your deeds.

Answer: If the sheep are fed from the owner's expenses, they have no Zakat. If they were grazing freely, they have Zakat which is one sheep not less than a year old and not less than two years old from goats. However, Al Malikiyah imposed Zakat on grazing livestock as well as others. As for the four cows, they have no Zakat because they did not attain the minimum amount liable to Zakat. And Allah knows best.

5- Question: I have a number of camels; seven or eight which are in possession for one year. Are the young camels like the old? Please, tell me about the Zakat upon camels.

Answer: the young and old camels are grouped in calculating Zakat if the old camels attain the minimum amount liable to Zakat and are in possession for a year. There is no Zakat on camels unless there are five of them, they have been grazing freely and they have been in one's possession for a year. When the camels are five, their Zakat is one sheep (shah). When they are ten, their Zakat is two sheep. When they are fifteen, their Zakat is three sheep. When they are twenty, their Zakat is four sheep. However, when they reach twenty-five, the due Zakat is a she-camel (bint makhad) which is a year old and starting the second. If these camels are fed from the owner's expenses, they have no Zakat according to the majority of scholars. However, Al Malikiyah imposed Zakat on grazing livestock as well as others. And Allah knows best.

6- Question: Please, inform me about Zakat upon cattle if sheep are grouped with goats and is it one sheep for every forty sheep? Or what?

Answer: the goats and sheep are grouped in calculating Zakat. If their number attains forty, they have Zakat because they are one category and according to the majority of scholars, the sheep and goats should be pastured by themselves and you do not afford their expenses of fodder. Zakat is upon cattle that are grazing freely as the Prophet (PBUH) said," As regards the Zakat for the (flock) of sheep."

However, Al Malikiyah imposed Zakat on grazing livestock as well as others. Zakat is one sheep for a number of forty sheep and when the herd counts forty freely grazing heads at the end of the year, its Zakat is one sheep. This is applicable until the number reaches 120, at which point, the Zakat is two sheep. Zakat between 40 -120 is one sheep. And Allah knows best.

7- Question: Is it allowed to replace Zakat upon sheep by money?

Answer: Zakat upon cattle should be paid in specie from the same possession of Zakat payer according to the majority of scholars in contrast with Al Hanafiyah who permits paying Zakat in specie or cash. It is allowed to pay Zakat upon cattle cash if there is advantage in paying it cash. And Allah knows best

Fatwas about Zakat upon Plants and Fruits:

8- Question: I have a land planted with olive; is Zakat applicable for crop or profit after calculating the expenses? The land is irrigated by rain besides irrigation by financial value; is its Zakat a tithe or half a tithe?

Answer: Zakat of plants and fruits is due in its harvesting day. The minimum amount liable of Zakat is five awsuq that equals (653 kilograms). If the crop attains this amount, Zakat is valued according to irrigation method. In the previous question, the land is irrigated by rain and irrigation machine. If the large part is irrigated by rain, Zakat is 10 % and if it is equal, Zakat is 7.5 %. If the large part is irrigated by the owner's effort, Zakat is half a tithe (5%) and Zakat is taken from this crop i.e. from the total amount of the olive fruits. If irrigation method is unknown, Zakat is 10 %. And Allah knows best.

9- Question: I have farms and I work in marketing dates; is it permissible to pay Zakat cash instead of dates? And what is Zakat amount if it is irrigated by machines?

Answer: yes, it is allowed to pay Zakat cash if it is difficult to pay Zakat of dates. According to the mentioned method of irrigation, Zakat is half a tithe (5%) if the crop attains Nisab (653 kilograms); it is not necessary to be in possession for one year as Zakat is due in harvesting.

10- Question: I have dates land and the crop is sold in the market; is it allowed to pay Zakat from money? And how can I calculate it? I have also (roodes) in the farm; does it have Zakat?

Answer: Zakat upon dates is a tithe if it depends on the natural sources of irrigation like rains and springs. Zakat upon dates is half a tithe if it is irrigated by machines. It is allowed to pay Zakat cash of the price of dates in case of marketing the crop and it is not necessary to be in possession for one year as Zakat is due in harvesting. 

(Roodes) has no Zakat because it is not from the crops upon which there is Zakat. Zakat is applicable to (roodes) price if it attains Nisab and be in possession for a year just like money and Zakat upon money is equal to (85) gram of pure gold according to market price. And Allah knows best.

11- Question: I have an amount of money equal to 25 thousand as a result of selling dates of my own farm provided that I did not pay Zakat upon dates. In addition, this amount is in my possession for a year; what is its Zakat in case I was irrigating the land by machines?

Answer: As long as you were irrigating the land by yourself, Zakat is half a tithe (5%). You have sold the crop also, so, Zakat is applicable to its price with the same rate. Zakat will be 1250 dirham that you should have paid it in harvesting time as it is not necessary to be in possession for one year. Therefore, you should pay Zakat immediately.

12- Question:  I earn money from planting celery which is from monthly crops; how could I calculate its Zakat, may Allah reward you for your deeds?

Answer: Celery is not from the categories upon which Zakat is applicable according to the majority of scholars in contrast with Al Hanafiyah, so you do not have to pay Zakat. However, in case of selling the crop, you should apply the conditions of Zakat upon its value. If the price attains the minimum amount liable to Zakat and is in possession for a year, Zakat is quarter a tithe (2.5%).

13- Question: I have a farm with no plants or fruits and I do not benefit of it; is there Zakat upon it?

Answer: Zakat is not applicable to this land because it is not planted, rented or offered to sale and Allah knows best.

Fatwa about Zakat upon Money:

 14- Question: What is the Zakat upon 500 dirham?

Answer: in general, the money possessed should attain Nisab that equals 85 grams of pure gold with its current price, which is 4000 dirham. The price might increase or decrease according to gram value in the market. Therefore, the amount of 500 dirham has no Zakat and Allah knows best.

15- Question: is there Zakat upon the salary? I have 18000 dirham in the bank.

Answer: the money of salary is from utilized money that has two options: you may possess it for a complete year if it attains Nisab, and then there is Zakat upon this money. You should apply this method in every salary you get. The other option is possessing money which attains Nisab and a year has passed. Then you could pay Zakat for this amount and what you added to that amount during that year and it will be accepted Zakat if Allah wants. The money added to the basic amount during the year and a year did not pass has two opinions. You could pay its Zakat from the basic amount of money that is possession for a year. No doubt, paying Zakat all at the same time for the whole amount of money is easier than paying Zakat for each amount of the money.

Zakat upon 18000 dirham is 450 dirham and Allah knows best.

16- Question: I have (10000 dirham); how much is its Zakat?

Answer: Zakat upon (10000 dirham) is quarter a tithe (2.5%) if a year has passed. Its Zakat is 250 dirham and Allah knows best.

17- Question: what is the minimum amount of gold liable to Zakat?

Answer: the Nisab of gold is 85 grams of pure gold if this amount was in your possession for a year. Zakat upon gold is quarter a tithe (2.5%) of gold or its value in the market in the time of paying Zakat.

18- Question: What is the Nisab of Zakat? What is the rate of Zakat upon money?

Answer: The minimum amounts liable to Zakat differ according to types of money. Gold Nisab starts from 85 grams and silver Nisab is 200 dirham (595 gram).there Zakat upon gold and silver is quarter a tithe (2.5%) if the possessed amount attains Nisab.

The minimum amount of money and commercial stuff liable to Zakat equals 85 gram of gold i.e. value of money Nisab and Zakat rate is quarter a tithe (2.5%).

The minimum amount of plants and fruits liable to Zakat is five Awsuqs (653 kilograms).

The Nisab of sheep is forty sheep, Nisab of cows is thirty cows, and camels' Nisab is five. And Allah knows best.

19- Question: I have an amount of money more than the minimum amount liable to Zakat. I also have a debt less than the possessed amount and paid from time to time. Is this debt, which is part of the possessed amount, included in Zakat? Or is the debt is separated from the possessed amount and then Zakat is paid?

Answer: if you possess money that attains Nisab, a year has passed and not used in paying the debt, then you should pay Zakat without discounting debt value because it is an amount possessed by a Muslim, attains Nisab and a year has passed. Zakat rate is 2.5% and Allah knows best.

20- Question: I have gold of 21 carats weighing 289.4 gram, of 22 carats weighing 2.27 grams and of 18 carats weighing 72.75 gram; how much is their Zakat?

Answer: Zakat upon the total amount of your gold is 407 dirham if a year has passed. The rules of calculating Zakat upon gold is attaining Nisab, 85 gram of pure gold, passage of a year and Zakat rate is 2.5 %. The amount less than the specified rate have no Zakat. And Allah knows best.

21- Question: I want to know Zakat upon (38000) dirham.

Answer: Zakat upon this amount is (950) dirham if a year has passed. And Allah knows best.

22- Question: I want to know how to calculate Zakat upon money.

Answer: Money should meet the conditions of Zakat. First, the amount of money should attain Nisab that is 85 gram of pure gold with its price in time of Zakat, is nearly 4000 dirham. Second, a year has passed. Zakat rate is 2.5 %.

23- Question: I have participated in monthly assembly fund with ten persons participating. Every person pays 2000 dirham monthly and the assembly fund continues for five years. One person will receive 120000 dirham every six months. How is Zakat upon this assembly fund calculated? How much is Zakat upon every person?

Answer: the person who takes the money should pay Zakat after passage of a year that starts at time of receiving the money. There is no Zakat if he spends all the money. 

The other participants in assembly fund are subject to Zakat upon debt. If the debtor was confident of getting his money, he should pay Zakat upon his contribution in the assembly fund besides his special money. If he was not confident of getting his money, he should not pay Zakat even if he gets his contribution in the fund. He should pay Zakat upon his special money in case of meeting the conditions of Zakat. He should calculate his contribution in the fund in time of receiving the money.

It is permissible for the participants in the fund to pay Zakat upon the total money of the fund as it is allowed to pay Zakat upon the mixed properties except the cattle, so there is no Zakat upon the participants.

The condition of Zakat upon that fund is applied since the time of its beginning. However, that condition can not be fulfilled because the money is distributed every six months. Thus there is no Zakat upon the fund in that case. And Allah knows best.

24- Question: I have gold from the first day of my marriage and I have no money to pay its Zakat; shall I sell part of gold to pay its Zakat?

Answer: Scholars, like Al Shafi'yah, Al Malikiyah and Al Hanabilah, agree that no Zakat has to be paid on jewelry in contrast with Abu Hanifa who holds that Zakat is compulsory on gold and silver jewelry provided they constitute a Nisab.

As for the second part of the question, it is allowed to sell part of your gold to pay Zakat. And Allah knows best.

25- Question: Is it possible to pay Zakat upon money after passage of ten months of the year? I will give some one a loan from this amount; shall I pay Zakat before or after giving the loan?

Answer: it is permissible to pay Zakat before passage of a whole year. If you pay Zakat before giving the loan, there is no Zakat on the debt after a year has passed. If you lends the money then you pay its Zakat upon your money, you should pay Zakat upon debt besides all your money. You may also pay Zakat after receiving the debt. And Allah knows best.

26- Question: How much is Zakat upon (400) gram of gold ingots? May Allah reward you for your deeds.

Answer: Zakat upon (400) gram of gold ingots is quarter a tithe (2.5%) or quarter of its value according to market price in time of paying Zakat i.e. 25 dirham for each 1000 dirham and Allah knows best.

27- Question: I want to ask about Zakat upon money; I have an amount of 40000 dirham collected along several months. How much is its Zakat?

Answer: as for this amount, you have collected it in different periods. That means that you add 5000 dirham every month. Zakat upon money is paid after passage of a year. Therefore, you will pay Zakat for an amount every month. For facilitation, you could calculate Nisab from the first day you owned the money which is nearly 4400 dirham and after passage of a year, you could pay its Zakat and add every amount added to the money because it is allowed to pay Zakat in advance. And Allah knows best.

28- Question: We have a deposit in bank; is it allowed to pay Zakat to our son (student) as our father might be obliged to borrow in some times?

Answer: Scholars agreed on disability of paying Zakat from origins to branches i.e. from fathers to sons as well as Zakat from branches to origins i.e. from sons to their fathers or mothers, husband to wife because expenditures are obligatory in this respect. Where expenditures are not obligatory in case of paying debt or seeking education, this matter is not obligation on the father is allowed to give them for their poverty. And Allah knows best.

29- Question: Please, inform me about the mathematical issue for transforming gold of 21 carats to 24 carats and how can I calculate its Zakat?

Answer: Method of calculating Zakat upon gold: first, weigh the possessed gold then multiply the result in gold carat and after that, divide the outcome by 24. The result will be multiplied to 2.5 %, and the result is gold Zakat. (Gold weigh X gold carat χ 24) = pure gold X gram price X 2.5 % = Zakat amount. And Allah knows best.

 30- Question: I want to know which type of gold has Zakat; jewelry or saved gold? Is there distinction between white and yellow gold?

Answer: Zakat upon gold is obligatory whether it was white or yellow because yellow gold is mixed with some metals to turn into white gold. All types of gold have Zakat whether it was (21, 22, 24 carats). Gold has Zakat in case of attaining Nisab that is 85 gram and a year has passed. Zakat rate is calculated by determining its price in the market in time of paying Zakat and multiplying the result in 2.5 %. And Allah knows best.

Abu Hanifa agreed on obligation of Zakat upon jewelry in contrast with Malik, Ash-Shafi'i and Bin Hanbal.

31- Question: I ask about Zakat upon jewelry of the woman. Is it true that there is Zakat upon woman's jewelry that equals the specified amount of her counterparts of the same social level?

Answer: Abu Hanifa agreed on obligation of jewelry of woman in contrast with Malik, Ash-Shafi'i and Bin Hanbal who agreed that there is no Zakat upon jewelry because it is not prepared for increase or development like clothes. However, Al Shafiyah stipulated the amount of woman's jewelry should not exceed the specified amount of her counterparts in the social level and what exceeds the normal amount has Zakat. No doubt, the first opinion protects Muslims and acquits conscience. And Allah knows best.

32- Question:  I need to know the alms (Zakat) amount due on my salary which is Dh.1500, beering in mind that I have a wife and a girl who is one month of age, what should I pay for Zakat?

Answer: Zakat is due on your salary only if you save it. When your savings reach the Nisab (the difined amount of what equals 85 gm of gold on which the Zakat must be paid) and a one complete year passes on it, you have to pay your Zakat. The Zakat amound is 2.5%. In your case, if you save some of your salary and this saving reaches the Nisab and a complete year passes, you have to pay your Zakat. But if your salary is totally spent on your family, you do not have to pay Zakat since you do have the Nisab. But you have another kind of Zakat which is Zakat Al Fitr (paid during the month of Ramadan and before the first day of the feast).

33- Question: Is there a Zakat due to be paid upon pearls?

Answer: No Zakat is due to be paid upon pearls or any other kinds of gems. Zakat is only paid upon gold and silver. But if those gems are used in trade and are priced, they should be valued and a portion of 2.5% of the Zakat must be paid after a one complete year passes in condition that the value reaches the Nisab or more. The Zakat on gold is due when the amount of gold reaches 85gm or the value of the same.

34- Question:  I have a share deposit in one of the Islamic banks, should the Zakat be paid upon the capital or upon the capital and its interests?

Answer: The Zakat should be paid upon the capital and its interest after one complete year passes. The due amount is 2.5%.

35- Question:  I borrowed a one-million Dirhams loan to buy trading commodities, is there a Zakat that should be paid upon the money?

Answer: Since money is converted to goods before one complete year passes, no Zakat is due. A new year should be accounted for the goods that starts from the day of selling. When a one complete year passes on the trade, the goods is valued in the end of this year, if the goods is wholesold the, it should be valued in whole. If it is retail sold, it should be valued in retail. The value is added to the cash and then a portion of 2.5% should be paid upon the whole amount of the money. According to the Shafi'i school of thought, the year starts in the date of getting the money regardless of converting it to goods or any other form.

 36-Question: My husband is unemployed, and I have a job. One year ago I started saving some of my salary to build a house. My savings reached DH 17000. My husband does not know about this savings. Should I pay a Zakat upon this savings? Is it permissible for me to pay the due Zakat for my husband and my brother who is about to join college bearing in mind that my father is a needy person?

Answer: If one complete year passes and you are still keeping the  Dh 17000, you must pay a 2.5 % of the whole amount of money as a Zakat. Paying your Zakat to your husband and your brother is permissible since they are needy.

37- Question: Is it permissible to keep some of the Zakat money to be paid to some people later?

Answer: The Zakat must be paid when it is due. If you keep some of it, you are committed before Allah to pay it. So it is better to pay it when it is due.

38- Question: What is the Nisab of gold and how is it paid?

Answer: The Zakat upon gold is due when the following conditions are provided: (1) the gold reaches the Nisab which is 85gm and (2) one complete lunar year passes starting from the date of owning this Nisab of gold. Each year passes a portion of 2.5% is due to be paid from the gold itself or its value. If the gold you have does not reach the Nisab or reaches the Nisab but does not complete one year, no Zakat is due.

39- Question: I have a Dh 15000-valued gold, how much the Zakat that should be paid?

Answer: The Zakat amount that should be paid is Dh 375

40- Question: I have an amount of money that increases and decreases along one year, how can I calculate the Zakat?

Answer: In your case you should define the date in which the money reaches the Nisab, then you start account for the year. After determining the beginning of the year, no matter the money increases or decreases since the Nisab is still. If one complete year passes and the money is stable at the Nisab amount, you must pay the Zakat which is 2.5% of the whole money whatever the decrease of increase. But if the decrease amount makes the money less than the Nisab, no Zakat is due. If the money increases after this and reaches the Nisab, you start accounting for a new year rather than the one accounted for before. There is another way for calculating which is each new money gained (not generated by the original) and reach the Nisab, a Zakat should be paid upon it after one complete year passes. The first way is easier.

41 Question: I did  not pay  the due Zakat upon some gold I have for some years, I  would like to know how can I pay my Zakat in this case?

Answer: If the reason behind postponing the pay of Zakat is negligence or ignorance, the Zakat must be paid for all these years. You have to define the Nisab of the gold which is 85 gm and determine the financial value according to the market price at that times. Then you have to account the total sum and pay 2.5% of the money. But if the reason behind postponing is a fatwa from a scholar who says, according to some trends i.e. the   Maliki, Shafi'i and Hanbali, which state that Zakat is not to be paid upon gold, you do not have, in this case, to pay Zakat for the past period. You have to pay Zakat from now on since all conditions are complete, according to the the Hanafi school of thought trend.

42- Question: I have some gold weighting 622.9 gm, and the price of the one gram of gold is ( Dh 51.18) I need to know how to account for the Zakat?

Answer: The Zakat upon gold is due when conditions are complete. The conditions are: (1) meeting the Nisab, (2) one complete year must pass, (3) complete possessing of the gold and (4) you should be a Muslim. The Nisab means 85 gm and more, as if the amount is lesser than this no Zakat should be paid. The portion is 2.5% of the gold. It is permissible to pay the Zakat in money not gold but you have to evaluate the gold by money according the gold price in the market on the day of paying the Zakat not on the day of purchasing the gold. In your case as per the weight you mentioned you have to pay Dh 798.

 43- Question: I got money that accumulated within a year or more and reached Dh 65000, should I pay the Zakat as a whole?

Answer- The conditions of paying Zakat are:  (1) meeting the Nisab, (2) one complete year must pass, and the Nisab means 85 gm and in Dirhams is about (4100). The accumulating money should be treated as follows, at the time this money reaches the Nisab, you have to start accounting for the year. When a complete year passes after reaching the Nisab, you have to pay Zakat upon the money which reached the Nisab. For the money earned after reaching the Nisab, you can pay its Zakat if you want to hurry in paying it or you can wait till one complete year passes on the late money. The due Zakat upon Dh 65000 is Dh1625.

44- Question: I have Dh100000 and before one complete year passes I got another Dh 100000, should I pay Zakat for the first amount or should I wait for another year to pass on the second amount and pay the Zakat upon all?

Answer: The Zakat is due only on the first amount of money and it is permissible to pay the Zakat for both at the time of paying the Zakat of the first.

45- Question: I have Dh 100000 savings of the salary, should I pay Zakat upon it? And how much is it?

Answer: For the money got from the salary, tow things should happen, first the money should reach the Nisab, and one complete year should pass. This means that you will pay the Zakat of this year in the next year. The portion is 2.5% of the whole money. The Zakat of Dh 100000 is Dh 2500.

Every Ramadan, I used to check all bank reports and see my money amounts and then pay my Zakat upon the least amount because it the amount on which one complete year past. My question is, is my action right, and should I define a certain day in Ramadan on which I pay my Zakat?

Answer: Your accounting for the least amount is right but it is better to pay your Zakat upon any amounts on which one complete year passes, in order not to be occupied by any other accounts. For defining a certain day on which you pay your Zakat, it is better to do so in order not to be late or you may miss paying the Zakat. For the money you lent or earned from a trade, you should pay upon its real capital.

48- Question: My husband borrow an amount of money from me, I intend that if he can pay it back I will take it. But if he can not pay it back, I will not ask him to pay and will forgive him. I gave him a peace period, should I pay Zakat upon this money?

Answer: No Zakat is due upon loans. If one complete year passes and then your husband pay it back at any time after this year, you have to pay the Zakat for one year only after getting the money.

But if the rest does not reach the Nisab, no Zakat is due then. The Nisab is the value of 85 gm of gold, which is about Dh 4000.

56- Question: I have a land that is hired by someone for a certain amount of money that is include in my income, how can I pay my Zakat?

Answer- No Zakat to be pain upon the land but the Zakat is paid on the rent only when this rent reaches the Nisab and one year passes, then 2.5% should be paid. The person who cultivates the land should pay a Zakat upon the crops cultivated. If the land is cultivated and irrigated by natural sources without any cost born by the cultivator the portion of Zakat is 10%. But if irrigation is costly, the portion of Zakat is 5% and if irrigation is mixed the portion is 7.5%.

Answer- This land is one of three:

1-      if it is a personal property, no Zakat is to be paid

2-      if it is for commercial purpose, you have to wait till one year passes, if it is still in your hand, you have to estimate its value in money and pay a portion of 2.5% of this value.

3-      If it is rented you have to pay the Zakat upon the rent value not upon the value of the land in condition that the value of the rent reaches the Nisab. The Nisab is the value of 85gm of gold. If you spend the rent before one year passes, no Zakat is to be paid.

Answer- in the end of the year you have to value the goods in your shop excluding the firming assets. You should be ware of the way of selling (whole selling or retail selling) . After evaluating the whole value of your goods you have to pay 2.5% of the total amount calculated then.

62- Question: I have a shop and a factory, and also I have some partners and I have some investments like debts. I pay my Zakat in a portion more than 2.5% of what I have. I pay my Zakat for my relatives and neighbors and the poor. Is this money I pay counted of the Zakat?

Answer- if you pay at the time of paying the Zakat and you bear the intention of paying Zakat, this money is accepted for Zakat. But if you pay this money with the intention of charity not Zakat, you still have to pay your Zakat since Charity can not replace the Zakat.

Paying your Zakat for your relatives and neighbors is permissible. Allah says: "Charity is to be paid for the poor ……….." (Al-Tawbah: 60), excluding parents and wife or sons or daughters. You will be rewarded twice, for the Zakat and for kindness to relatives.

63- Question: I have a shop for shoe selling, I need to know how to pay my Zakat upon it, knowing that I did not pay my Zakat for a long time.

Answer- After one complete year passes on your trade, you have to evaluate your goods in money. After calculating your total money, excluding debts, and other commitments, you have to pay 2.5% of the total money. The following equation can illustrate the Zakat:

Answer- Yes, you have to pay the Zakat retroactively. The Zakat is calculated and paid as follows:

For the past Zakat, you have to check it, if you can define it accurately you pay upon the estimated money. If you can not define it accurately, you put a random value and pay upon it.

68- Question: I have 200 shares, and the purchasing value is Dh10000 and one year passed on them, what is the Zakat that is due to be paid? 

Answer- there are tow kinds of the shares, investment shares (for trade purposes) upon which the Zakat is paid on the basis of profit and loss 2.5% of the total value of the money. The second kind is shares in a company that pays the Zakat of the shares, then you should not pay the Zakat.

If the shares are in an industrial company and you intend to manipulate the returns of them, you should pay the Zakat upon the returns value (profits& interests) 2.5% of the total value. It is better to know about the goods and properties against your shares to value them and pay your Zakat upon it.

69. Question: I have stocks not for sale or trade; do they have Zakat?

Answer: As you mentioned, there is no Zakat upon stocks, which aim at benefiting from profits - assets of shares are fixed and not circulating as shares of real estate companies. In this case, Zakat is applied upon the profits of the shares if they attain Nisab and a year has passed. If the shares are for trade and their assets are circulating in purchase and sale as shares of the most common Islamic banks or cooperatives; in this case, there is Zakat upon shares and profits if they attain Nisab and a year has passed even if they are not intended for trade.

71. Question: I was trading in shares selling and buying, praise be to Allah as I gain from this trade six months ago; is there Zakat upon these shares?

Answer: two conditions of Zakat upon money and possessions must be fulfilled. First, the possessions must attain Nisab. Second, a year should pass with this Nisab.

As for your case, if the shares attains Nisab in time of paying Zakat and a year has passed, then Zakat should be upon the assets of shares besides the profits. Zakat will be 2.5% of the total amount. If a year has not passed since the date of trade, then these shares have no Zakat and Allah knows best.

72. Question: I have shares in several companies, deposits in Islamic bank of Dubai, real estates taken by installments from many ways. The total value of the real estates is triple the value of the shares; is there Zakat upon shares and deposits?

Answer: As for shares, they have two divisions:

First: Zakat is applied upon shares for trade according to market price by 2.5% if they attain Nisab and a year has passed.

Second: shares purchased for benefiting from profits only have two cases: first, assets of the shares are for commercial company as cooperatives, there is Zakat upon these shares like the first division for assets and profits. Second, if the assets of shares are fixed and not circulating like the shares of real estate and telecommunications companies, Zakat is applied to profits if they attain Nisab and a year has passed.

As for deposits and their profits, they have Zakat with 2.5% if they attain Nisab and a year has passed.

As for debt due to real estates that you have possessed, there is Zakat upon what you possess of money not used in settling debt, attains Nisab and a year has passed because debt does not hinder Zakat upon money.

As for real estates being in your possession, there is Zakat upon real estates if they are rented or for sale. Zakat is upon value of rent if it attains Nisab and a year has passed since the date of contract start to its end. If the value of rental is spent before completing the year or the remaining part does not attain Nisab, then it has no Zakat for not meeting the conditions of Zakat.

If the real estates are for sale as you bought them for trade, then Zakat is applied on their essence if they are still existent and a year has passed by evaluating them according to the market in time of paying Zakat. Zakat will be 2.5% of the total amount. If these real estates are personal possessions and not for sale or rent, they are not liable to Zakat.

The minimum amount liable to Zakat is 85 grams of pure gold and Allah knows best.

73. Question: I have a number of shares in an Islamic bank, since the date of buying them by 107 dirham for each share, I did not buy or sell and I did not pay attention to their value; how could I calculate their Zakat?

Answer: As for Zakat upon shares, the price of shares is determined by market value if they attain Nisab and a year has passed. Zakat is 2.5% whether for trade or benefiting from. As for last years, you should calculate your possessions at the end of each year considering their market value in time of paying Zakat as well as considering your a quittance and Allah knows best.

Question: I have shares in cooperative; I was informed that Zakat is applied on the market value of shares besides their profits because they are trade offers but shares of the cooperative are not pertaining to market as well as their value can not be calculated; how should I pay Zakat? By purchase value or what?

75. Question: I started trade of shares with a capital of 100.000 dirham, after that, when I gain money, I buy new shares for speculation. Shall I calculate a new year for the news shares or all the shares are merged in one trade?

Answer: You should determine start of the year for the new shares because they are bought by an amount liable to Zakat and were not from the first shares. However, it is difficult for people to determine a year for each set, so the whole shares are set for a year, and then Zakat is paid from the total amount. Thus, the amount whose Zakat is applicable, is paid and as for the amount whose Zakat is not applicable, its Zakat is paid in advance. Paying Zakat in advance is allowed for the majority of scholars and Allah knows best.

76. Question: the sessions of general meetings of some companies are held recently where distribution of profits of the last year is approbated and divided into bonus shares and monetary amounts. How can Zakat upon these bonus shares be calculated? Is Zakat calculated by market value for commercial company or service company intended for trade or should shares be treated as utilized shares?

Answer: The shares are treated as profits because they are result of trade in the previous shares and they should be divided cash but the assembly considered them as bonus shares that are more profitable than cash. Therefore, these shares are merged to the previous shares, profits are merged to its base and then Zakat is paid from the total amount and Allah knows best.

77. Question: I want to know who recipients of Zakat ul-Fitr are and when Zakat ul-Fitr is due; day, night or before people going to 'Eid prayer.

Answer: recipients of Zakat ul-Fitr are the poor and the needy according to what became evident to all people. It is paid before 'Eid prayer. However, it is allowed to pay Zakat a day or two before 'Eid or from the first day f Ramadan according to ash-Shaf'i (in his original opinion) and there is no specific condition for defining its time day or night as it is paid at any time and Allah knows best.

78. Question: Being sick and old, my grandmother cannot fast Ramadan; how much does she pay for each day?

Answer: she should pay a ransom for each day and ransom is feeding a poor person for every day. Ransom is 20 dirham for each day and it could be given to charitable bodies. He was preparing a banquet in the first day of Ramadan and invited thirty person of the needy for breaking fast in Ramadan.

Answer: Zakat ul-Fitr is incumbent on every free Muslim, young and old, male and female, free and slave, who possesses one Sa' of dates or barley which is not needed as a basic food for himself or his family for the duration of one day and night. Nowadays, most people have the sufficient means of living, so you should get a loan to pay Zakat ul-Fitr than you settle your debt from the salary and Allah knows best.

Answer: you should pay Zakat ul-Fitr after 'Eid prayer and it is considered a settlement. The servant should pay Zakat ul-Fitr for herself and it is allowed to pay Zakat ul-Fitr for her by her knowledge.

85. Question: I want to know the recipients of Zakat and is it allowed to pay Zakat for brothers and sisters?

Answer: Allah, the Most Exalted has specified recipients of Zakat in the following ayah: "Zakat expenditures are only for the poor and the needy, for those who collect them, for those whose hearts are to be reconciled, for the freedom of those who are captives and in debt, for the cause of Allah, and for the wayfarers; [it is] a duty imposed by Allah. Allah is the Knower, the Wise", [at-Tawbah 9: 60]. Therefore, recipients of Zakat are eight categories: the poor, the needy, those who collect Zakat, whose hearts are to be reconciled, freeing captives, person in debt, for the cause of Allah and wayfarer. If any category of the previous types applies to brothers and sisters, it is allowed to pay Zakat to them. In this case, you will have two rewards: reward of charity and reward of kinship and Allah knows best.

If he is poor, it is allowed to give him Zakat because house is from the necessary demands of man and you will have two rewards: reward of charity and reward of kinship and Allah knows best.

97. Question: Is it allowed paying Zakat to some one without informing him that these are Zakat money?

Answer: It is permitted to pay Zakat to any one without informing him if he deserves Zakat and is from recipients of Zakat. It is preferable to inform him about Zakat because he may refrain from taking Zakat. If you knows that he accepts Zakat, you may give him without his knowledge and Allah knows best.

98. Question: Is it lawful to pay Zakat to non-Muslims?

Answer: Allah, the Most Exalted has specified recipients of Zakat in the following ayah: "Zakat expenditures are only for the poor and the needy, for those who collect them, for those whose hearts are to be reconciled, for the freedom of those who are captives and in debt, for the cause of Allah, and for the wayfarers; [it is] a duty imposed by Allah. However, there is one category of Zakat recipients – whose hearts are to be reconciled, this category may be from non-Muslims who may come to Islam through the reconciliation of their hearts and people whose evil is feared, and it is hoped that money, if given to them, will neutralize their hostility. It is not allowed to pay Zakat to non-Muslims except for those mentioned before and Allah knows best.

99. Question: I have a dear friend who has debts, obligations and will get married; is it lawful to give him Zakat without informing him.

 Answer: It is allowed to pay Zakat to person in debt if he has not sufficient money to pay his debt. He is considered from the category of persons in debt. It is preferable to give him Zakat without informing him, so you could give your friend from Zakat by name of gift or assistance and Allah knows best.

101. Question: I have relatives outside UAE and they have not the sufficient means of living; is it allowed to give them Zakat, knowing that they have a land that suffices them in case of selling it but the common traditions prevent them from selling the land.

Answer: Yes, it is allowed to give them Zakat. Possessing a land does not prevent them of receiving Zakat if they were poor. They are similar to those who own house to live in or cars to ride, as they are not obliged to sell them. They deserve Zakat if they are from the recipients of Zakat stated in Zakat ayah and Allah knows best.

102- Question: Is it permissible to collect Zakat to buy a small house for a family needing house? 

Answer: It is allowed to buy a house from Zakat money if the family really needs a house and Allah knows best.

103. Question: What is the rule of paying Zakat to the poor of non-Muslims to bring their hearts together to Islam?

Answer: It is not allowed to pay Zakat to non-Muslims. Those whose hearts are to be reconciled are determined by majority of scholars and not by personal opinion and Allah knows best.

104. Question: Is it allowed paying Zakat besides Zakat ul-Fitr to our brothers aggrieved by earthquake in Pakistan, I follow the Islamic school of Abu Hanifa and there is no objection of paying Zakat in cash?

Answer: There is no objection for transferring Zakat from a country to another if necessary, as the case in Pakistan. Therefore, there is no objection to sending Zakat money with the suitable way and Allah knows best.
